Injection Malpractice-Injection Too High
Injections can cause injury. This is sometimes the explanation for shoulder symptoms.
What can happen with an injection caused injury is that the needle containing the vaccine is injected too high in the shoulder. It should be injected in the center of the deltoid muscle. That way it is going into the most meaty part of the muscle. If instead the needle is injected too high then the vaccine may go into the bursa or sac. This bursa separates the bone at the top of the shoulder from the rotator cuff. Also an injection caused injury can sometimes result in a rotator cuff tear.
Such an injury makes many simple tasks very difficult. Such tasks as lifting the arm, changing a light bulb, reaching behind become very painful. The shoulder is one of the most complex and unstable joints in the body. As a result it is very susceptible to wear and tear and also to injury.
Aside from causing torn rotator cuffs, such injections can get into the bursa. This may cause a frozen shoulder. This is a result of excess fluid in the bursa. Call, or contact us for a free consult.
Injection Malpractice-Compensation
Injection caused injury may be a basis for a claim under the Federal Vaccination Act. This Act provides for payment to persons who have been injured from any vaccine. As of May of 2015 102 such claims have been paid out totaling approximately $16 Million.
In addition sometimes what is seen with an injection caused injury is that the needle doesn’t necessarily tear the rotator cuff but stirs up a preexisting inflammatory condition. As a result this can make a tear worse or can produce a great deal of pain.
Lethal Injections
Not to be too macabre but some injections are meant to be harmful.
Lethal injections as used in Montana have been ruled a breach of the constitution. On September 7, 2012 a state court judge from Montana declared the lethal injections used by the state to execute prisoners to be unconstitutional. What the state prison system was doing was using a three drug cocktail. First of all the inmate was sedated to render him unconscious. Then the lethal injection was given. The three drug combo differed from the two drug combination that is spelled out in state law. As a result the Montana Judge held that variance between the procedure used and what is mandated by the state code creates the chance for error in the process.
In addition, the Judge noted that the prison warden did not have any medical training. Yet he was the one making the judgment that the prisoner was unconscious before the fatal drug was given. The prison official setting up the execution procedure was not required to have any particular experience with IV injections.
For all of those reasons the process used in the Montana prison system was held to be flawed. However all of those errors were able to be corrected.
