1956 Doerr v. Barnes, 198 Va. 306, 94 S.E.2d 271.

Passenger, in exiting car, depressed accelerator. Defendant not guilty of gross negligence.

1952 Savage Truck Line v. Traylor, 193 Va. 579, 69 S.E.2d 478.

Plaintiff’s truck struck in rear by defendant’s truck. Defendant had attempted to stop in order to avoid collision; however, instead of hitting brake, defendant hit accelerator and made collision inevitable. Plaintiff’s truck, however, had stalled on highway and plaintiff had failed to place flares on road as required by statute. Negligence per se on plaintiff’s part barring recovery.
