Negligent Performance of Contract-Cases

1991 Miller v. Quarles, 242 Va. 343, 410 S.E.2d 639.

The principal is liable to other contracting party who has been damaged by the agent’s negligent performance of the principal’s contract with the other party. Likewise, the agent would be liable for such negligence.

1984 Allen Realty Corp. v. Holbert, 227 Va. 441, 318 S.E.2d 592.

Plaintiff alleged that defendant while acting in the scope of his employment was negligent in failing to disclose offers made. This was sufficient to withstand demurrer. An agent can be held liable for negligent performance of a contract to which he is not a party but to which principal is a party.
