Rebuttal-Cases
1988 Norfolk & W. Ry. v. Sonney, 236 Va. 482, 374 S.E.2d 71.
Trial court refused to allow rebutting witness to testify since not identified in response to interrogatories. This was abuse of discretion since rebuttal evidence was not inquired into in interrogatory.
1988 Henning v. Thomas, 235 Va. 181, 366 S.E.2d 109.
Question of extent of presentation of rebutting evidence is left to sound discretion of trial court.
1975 Turner v. Manning, 216 Va. 245, 217 St.2d 863.
Plaintiff endeavored to recall witness for rebutting when witness had previously testified as adverse witness for plaintiff and as witness for defendant. Trial court did not abuse discretion in not allowing this.
