Safety Regulations-Cases

1981 Mackey v. Miller, 221 Va. 715, 273 S.E.2d 550.

Airplane crash. Defendant violated F.A.A. regulations. Supreme Court did not decide whether this constitutes negligence per se.

1973 Norfolk S. Ry. v. Rayburn, 213 Va. 812, 195 S.E.2d 860.

FELA case. Violation of safety rule is not negligence per se but is only evidence to be considered with other evidence.

1966 Peanut City Iron & Metal Co. v. Jenkins, 207 Va. 399, 150 S.E.2d 120.

Workers’ compensation case. Intentional violation of well-known safety rule is willful misconduct by employee and defense by employer.
